LAUNCH OF .XXX sTLD
October 10, 2011

The following is a summary of the processes, procedures, and rules applicable to Registration and/or Reservation of an .XXX sponsored top level domain name.

Top level domain names (TLDs) with three or more characters are usually referred to as "generic" or "gTLD" (i.e. .com, .net, .org). Each gTLD has a designated Registry. The Registry is responsible for the technical operation of the TLD and is the authoritative master database of all domain names registered in a TLD. In this instance, ICM is the Registry of the .XXX sTLD.

What is .XXX?

.XXX is a new top level domain (sTLD) created specifically for members of the Sponsored Community, defined as individuals, entities and organizations in the adult entertainment industry.

Non-adult entertainment industry businesses may prevent their trademarks from being registered in the .XXX sTLD.

Registration/Reservation of .XXX sTLD

During the "Sunrise Period" that begins September 7, 2011, registrars for the new .xxx domain name registry will begin accepting registrations for .xxx domain names from members within the Adult Sponsored Community. During this time period the Registrars also request trademark owners file a request to block the registration of .xxx names that include their trademarks.

SUNRISE A - September 7, 2011 - October 28, 2011

Sunrise A is dedicated to members of the Adult Sponsored Community with either trademark rights and/or are owners of domain names in other TLDs which directly corresponds to the name in the Registration request.

SUNRISE B - September 7, 2011 - October 28, 2011

Sunrise B is dedicated to Intellectual Property rights holders who are non-members of the Adult Sponsored Community who wish to permanently block the trademarked string (i.e. ARIES.XXX) from being registered by others.

To be eligible to submit a reservation request, the name reservation must correspond to the entire text of a registered trademark or correspond to the complete textual component of a graphical or compound registered trademark. For example, the owner of the trademark ARIES13 cannot submit a reservation request for ARIS.XXX; the reservation request MUST be for ARIES13.XXX. If the reservation request is approved, such reservation does not result in a registration in the .XXX TLD but rather the domain name will resolve to a standard informational page reflecting the status of the name as reserved. There is a one-time flat fee for string blocking registrations of approximately $300.00. This fee is subject to change depending on the Registrar.

The Internet ownership information for all reserved names will state the Registry (ICM) as the Registrant and not the Sunrise B applicant

LANDRUSH - November 8, 2011 - November 25, 2011

Landrush is for members of the Adult Sponsored Community but not on a first come, first serve basis. Unlike Sunrise A, there are no qualification requirements needed for Landrush. Applications for competing names will go to a closed-auction at the end of the Landrush period.

Landrush applications may be submitted for any available .XXX names, meaning names that have not been reserved, restricted, registered, awarded, or otherwise allocated prior to commencement of the Landrush period.

GENERAL AVAILABILITY - December 6, 2011 - Ongoing

General availability is for members of the Adult Sponsored Community to register available .XXX names on a first come, first serve basis. Non-members of the Adult Sponsoring Community may apply for available "non-resolving" names in the .XXX sTLD. These names will not resolve to an active website.

Unlike Sunrise A and Sunrise B, there are no qualification requirements needed for the general availability period. This is helpful for trademark owners who want to block misspellings of their trademark registrations. For example, ARIES may also want to block the string ARES.XXX from registration. In this instance, unless ARIES owns a trademark registration for ARES, they will need to wait until the general availability period to apply for ARES.XXX.

The Registrant will be required to pay registration and renewal fees on the non-resolving domain names.

If you have any questions please feel free to contact us to discuss this matter further.
